“Windows Vista capable” case: start filing actions, Mr. and Mrs. Consumers!
4th May 2008
Finally, they put an end to the case of consumer fraud using the logo “Windows Vista capable”. The American Court rejected an appeal by Microsoft and finally permitted the use of the logo as a judicial precedent. This means that very soon the software giant may be lavished with claims about false informing.
A group of American lawyers managed to defend their position regarding “Windows Vista capable” as a consumer fraud. The point is that computers with the logo “Windows Vista capable” can only function normally with Vista Home Edition installed, depriving customers of many other Vista innovations. The court found the logo misleading, so buyers were entitled to file claims against Microsoft.
Microsoft, justifying itself, claimed that the logo guarantees “an opportunity to run Vista” without specifying some of its version features. However, the court found plaintiffs` position more right.
Microsoft can not be accused of ignorance, because partner companies, including Dell, warned it about possible problems. Well, now Microsoft will have to pay for the desire to distribute Vista by all possible means.
